Terms and Conditions of LHV Premium Card Travel Insurance

The terms and conditions of travel insurance describe the insurance cover of travel insurance, behaviour in the event of a loss event, and the principles governing the compensation of damage.

The purpose of travel insurance is to assist the insured person in the case of possible unexpected events related to the trip and to reimburse expenses, to ensure that the trip goes smoothly.

The insurance is valid together with the LHV Premium-Card (hereinafter the Card) issued to a private client. The insurance cover starts when the plastic card is activated and ends on the last day of the plastic card’s validity. If the plastic card is activated before you receive it, or if it is a virtual card, the insurance cover starts 72 hours after the card is activated. The insurance applies to trips that began from the home country and which started during the period of insurance cover.

The insurance provider is LHV Kindlustus (hereinafter LHV).
The policyholder is AS LHV Pank.

The Insured Person Person is a cardholder of up to 79 years of age (included) and his/her spouse or partner of up to 79 years of age (included) travelling with him/her, and their children and grandchildren of up to 21 years of age (included). The insurance cover does not apply to these persons if they travel separately from the cardholder, meaning that if they start the trip and return at a different time than the cardholder and/or use a different means of transport or stay in different accommodations. If a person is insured on the basis of more than one LHV bank card covered by travel insurance, the sums insured and benefit limits of the bank cards are summed up. If a person is insured with several LHV bank cards covered by travel insurance and/or with a travel insurance policy taken out with LHV, the maximum sum insured for medical insurance is € 1,000,000.

LHV shall compensate for the damages caused by an insured event up to the total sum insured specified in these insurance terms and conditions (hereinafter the Terms and Conditions) for all insured events of the same trip. The sums insured and indemnity limits are applied to each Insured Person separately.

Definitions

An insured event is an event provided for in the terms and conditions, in the event of which LHV must perform its performance obligation arising from the terms and conditions.
A loss event is an unexpected event that results in damage to property or health.
The sum insured is the insurable value of the insured object or the maximum monetary amount to the extent of which LHV shall indemnify the damage caused due to the insured event. LHV shall not compensate more than the sum insured specified in the terms and conditions for all insured events of the same trip combined. The amounts are per insured person.
The indemnity limit is the maximum amount of money to which LHV shall compensate the damage caused as a result of an insured event. The indemnity limit may be set for a specific event, risk, asset, or object. If indemnity limits are established in the terms and conditions of insurance for a certain event or expenses, LHV shall pay compensation up to the indemnity limit. The indemnity limit is not added to the sum insured, but is included in it.
The insurance deductible is the amount borne by the Insured Person in the event of an insured event. The insurance deductible is deducted from the insurance benefit payable. The deductible rate applies separately to each insured event. If, pursuant to the terms and conditions, the insurance benefit is subject to an indemnity limit, the insurance deductible is deducted from the actual amount of the damage.
The insurance remains valid for the first 90 days since leaving the home country. If the insured person cannot return from the trip by the expiry of the insurance period due to the insured event, the insurance cover is automatically extended by 48 hours.
The area of validity for the insurance is the entire world outside of the country. Travel interruption insurance is also valid in the home country in the cases provided in the terms and conditions.
The home country is the country where the insured person resides.
A trip is temporary travel by the insured person from their home country to one or more countries.
A public transport vehicle is a vehicle, including a ship, train, or plane that serves a regular line. A means of transport organised by a tour operator or a provider of accommodation, for example, a charter plane and a booked bus, is also considered to be public transport.
A smart device is defined as a smartphone, tablet, smart watch, smart pods and smart speakers.
An electronic device is a device that is used for entertainment, communication or other personal use, such as photographic equipment, video and audio equipment, desktops and laptops, and drones.
An event ticket is a ticket for a service, such as a play, a tour, a festival or a sporting activity, purchased for the purpose of leisure.

  1. Travel interruption insurance

  2. Travel interruptions are:

    • cancellation of the trip,
    • change of the travel plan,
    • interruption of the trip.

    Cancellation of the trip

    1. An insured event is an insured person’s cancelled trip or return from a trip to their home country if the reason for this is:

      • unexpected illness, serious injury or death of the insured person;
      • sudden illness, injury or death of a close relative of the insured person which makes the presence of the insured person necessary;
      • sudden illness, injury or death of the insured person’s travelling companion with whom he/she was planning to travel, which prevents the travelling companion from travelling;
      • sudden damage to the property of the insured person in their home country, which necessitates his or her presence;
      • a strike or natural disaster, the occurrence of which was not known to the public at the time the services were purchased and paid for.
    2. In case of trip cancellation, LHV shall reimburse up to € 2,000 of the cost of unused services paid for but not refunded by the service provider, including:

      • travel expenses,
      • accommodation costs,
      • event tickets up to € 150.

      Change of the travel plan

    3. An insured event is a change in the insured person’s travel plans due to:

      • delay or non-departure of a public transport vehicle, flight or booked bus, if the ticket had already been purchased or booked;
      • traffic accident involving an accident or an emergency stop of an aircraft, taxi, or rental or hire car, including due to a technical fault;
      • missing the transport for the following reasons:
      • delay or loss of baggage due to the fault of the transport company;
      • weather conditions or natural disasters;
      • criminal offence;
      • reasons arising from the transport service provider, including overbooking;
      • life-threatening condition, serious bodily injury or death of the insured person or a person he/she is travelling with.
    4. In the event of changes in the travel plan, LHV shall reimburse up to € 2,000 of the following costs:

      • reasonable travel and accommodation expenses to continue the journey;
      • the costs of unused services for which the person has paid but the costs of which are not returned by the service provider (travel and accommodation expenses, event tickets, etc.);
      • the cost for the following essentials while waiting for the public transport abroad, up to € 200 if the public transport is delayed for more than four (4) hours, and up to € 500 if the public transport is delayed for more than 24 hours:
        • the cost of meals and toiletries;
        • the cost of indispensable clothing if the insured person’s baggage is in the possession of a transport company.

      Interruption of the trip

    5. An insured event is the return of the insured person from the trip to the home country for the following reasons:

      • life-threatening condition, serious bodily injury or death of the insured person or a person he/she is travelling with;
      • sudden illness, injury or death of a relative in the insured person's home country, which makes the presence of the insured person necessary;
      • sudden damage to property in the insured person’s home country, making his/her presence absolutely necessary;
      • a strike or natural disaster, the occurrence of which was not known to the public at the time the services were purchased and paid for.
    6. In the event of a trip being interrupted, LHV shall reimburse up to € 2,000 of the following costs:

      • reasonable travel and accommodation expenses for the return of the insured person to his/her home country;

      • the cost of unused services that have been paid for but not reimbursed by the service provider (travel and accommodation expenses, etc.);

      • event tickets up to € 150;

      • if the interruption of the journey results in additional transport or accommodation costs and if the transport or accommodation services already paid for and not reimbursed by the service provider are not used, one of them will be reimbursed.

        Trip interruption due to an emergency

    7. The insured event is the evacuation of the insured person to the home country due to the following events that occurred during the trip:

      • war, armed conflict, terrorism or riots;
      • natural disaster;
      • pandemic or epidemic.
    8. In the event of a trip interrupted due to a state of emergency, LHV shall compensate travel and subsistence expenses for return to the home country from the occurrence of that event, within 14 days from the moment of the event specified in clause 1.7 taking place.

      Conduct in the case of travel disruption

    9. In the case of travel disruption, the providers of trip-related services (including travel service, accommodation service) must be notified immediately to apply for a refund or reimbursement of additional costs related to the disruption.

    10. LHV must be notified immediately of the travel disruption and the instructions given by LHV must be followed.

    11. In the event of falling ill, the person must contact a medical institution and provide LHV with an extract from their medical history.

    12. To establish the circumstances of the loss event, LHV may demand from the insured person, inter alia:

      • documents proving the costs incurred as a result of the incident, as well as a reply from the service provider as to whether and to what extent it will reimburse the costs;
      • a certificate from the transport company stating that the vehicle was delayed;
      • health data for the establishment of a loss event (including medical certificate and transcript of health data);
      • additional evidence, such as proof of departure and staying abroad;
      • explanations about the loss event.

      Exclusions from travel interruption insurance

    13. LHV shall not reimburse the costs related to a travel disruption loss event if the travel disruption is caused by the insured person’s:

      • health condition or changes in health not related to sudden illness;
      • mental and behavioural disorders, including depression;
      • pregnancy, related complications or delivery.
      • LHV shall not pay compensation if the trip is interrupted due to not having allocated time properly for layovers and security checks, regular weather conditions, characteristics of the local transport system, traffic congestion, etc.
        Example. The insured person is denied boarding because there was less time than planned to change planes and undergo a new security check;
      • missing or incomplete documents, such as an expired passport or a missing visa and/or vaccination certificate;
      • acts or omissions of the tour operator or travel agent or travel intermediary, as well as payment difficulties.
    14. LHV shall not reimburse the following costs related to the loss event:

      • loss of income and/or damage due to travel interruption caused by the loss of travel-related opportunities, such as a contract not concluded, missed contacts and experiences, also loss of income;
      • the costs of the repair, storage, write-down or transport of a means of transport, including the cost of returning it to the home country;
      • expenditure on food, drink, and other essential goods, unless these were essential while waiting for the public transport abroad and the public transport was more than four (4) hours late;
      • the cost of unused travel and accommodation services if the travel and accommodation expenses described in point 1.4 are reimbursed for the continuation of the journey.
    15. In the event of travel interruption LHV shall not reimburse the costs related to the loss event if the travel interruption is caused by:

      • the costs of unused travel services;
      • organising the evacuation of the insured person. Evacuation is based on instructions issued by local authorities or the Ministry of Foreign Affairs of the home country;
      • loss or expenses, if the event that caused the evacuation started before the insured person arrived in the crisis area of the event specified in clause 1.7.
      • if the Ministry of Foreign Affairs of the home country has published information on avoiding an area or country and the insured person travelled there after the information was published.

      General principles for the compensation of damages related to an insured travel interruption event

    16. In the case of an insured travel interruption event, LHV shall compensate the expenses of the insured person specified in the terms and conditions in proportion to their share of the expenses incurred.

    17. LHV shall not reimburse costs incurred by legal persons.

    18. Upon compensation of an insured travel interruption event, the deductible rate of € 50 applies for each insured event.
      Example. If a flight is delayed on both the outward and return legs of a single journey, two (2) separate deductibles will apply, which means that € 50 will be deducted from the amount of each compensation.

  3. Medical assistance insurance

  4. An insured event of medical assistance insurance is the following event starting in a foreign country that has occurred to the insured person:

    • an unexpected deterioration in health, the first symptoms of which appear during the trip and for the treatment of which they need urgent medical care;
    • death during the trip.

    Medical assistance insurance also covers participation in sporting activities such as cycling, skiing, running (including marathons) and triathlon competitions, as well as training camps for these sports.

    In case of an medical assistance insurance event, LHV shall indemnify the following expenses in an extent of up to € 750,000 (excluding dental care and medical aids subject to the indemnity limits set out below).

    1. Medical expenses and medicines
      The expenses on medications and medical treatment abroad during the trip and arising from the event of medical assistance insurance, if these were made within 60 days as of the occurrence of the insured event.

    2. Dental treatment
      Expenses due to the treatment of unexpected tooth pain in a foreign country and/or emergency dental treatment expenses due to an accident (e.g. a fall) during the trip, including examinations and medicines in the amount of up to € 500.

    3. Pregnancy-related medical care
      Compensation for emergency medical care expenses due to unexpected complications of pregnancy within the first 35 weeks of pregnancy.

    4. Medical aids
      The costs of repairing or replacing a prosthesis, hearing aid, or glasses of the insured person which were broken as a result of the insured event of medical care in an extent of up to €200 per insured event. Expenses for medical aids (e.g. glasses, hearing aids, wheelchairs, crutches) abroad due to the insured event of medical assistance insurance, if prescribed by a doctor, up to €200 per insured event.

    5. Burial or cremation costs
      Burial or cremation costs of the insured person abroad and/or costs of bringing his or her corpse or cremated remains home. Arranging for burial or cremation abroad or the method of transporting the corpse or cremated remains must be agreed with LHV beforehand.

    6. Travel expenses

      • Travel expenses of the insured person to receive medical care abroad.
      • Repatriation expenses of a seriously ill or injured insured person to his or her home country. A doctor, approved by LHV, shall decide whether and when it is possible and necessary to transport the insured person to his or her home country and shall decide on the means of transport to do so. The method of transporting the insured person must be agreed with LHV beforehand.
      • The expenses for the repatriation of a minor insured person travelling together with an adult insured person to his or her home country if, due to being hospitalised as a result of an insured event of medical insurance, the adult insured person cannot return to Estonia together with the minor insured person.
    7. Accommodation costs
      Additional accommodation costs for the insured person until returning to their home country if he or she is unable to return from the trip as planned due to an insured event of medical insurance. LHV reimburses the additional cost of accommodation in the same accommodation establishment or in an accommodation establishment of the same quality class.

    8. Medical documents
      Costs of drafting, reproducing, and sending of medical documents, if this is necessary to handle the claim.

    9. Family member travelling to the insured person or a travel companion staying with the insured person

      • Reasonable additional cost of accommodation of one travel companion abroad with a sick, injured, or deceased insured person and travel expenses to return to the home country, up to the insured sum for travel interruption, if it is absolutely necessary (e.g. mother staying with the child).
      • Travel, accommodation and food costs of one (1) family member of the insured person to travel to and back from the ill or injured insured person, if no travel companion stays with the insured person and if the insured person cannot be transported to the country of his or her country of residence within ten (10) days as of the insured event. The costs are reimbursed from the sum insured of the medical insurance of the insured person.

      Activity upon an insured event of medical insurance

    10. If, in the case of an insured event, the insured person requires medical care which is not hospital treatment, they may directly visit a licensed medical institution.

    11. If the insured person needs hospital treatment in the event of an insured event, he/she must call LHV as soon as possible.

    12. in the event of an insured event of medical assistance insurance, LHV shall indemnify for the hospital treatment, repatriation to their home country, burial or cremation of the insured person. LHV only reimburses the costs of these services if they have been coordinated with LHV in advance.

    13. In order to apply for the benefit, the following documents must be submitted:

      • notification of the occurrence and circumstances of the insured event and application for the insurance benefit;
      • medical certificate containing the diagnosis and date of the event;
      • invoices for medicines, treatment, accommodation service and transport;
      • if necessary, additional evidence to establish the circumstances of the loss event (such as proof of length of stay abroad, and health data such as a medical certificate or a transcript of medical records).

      Exclusions from medical assistance insurance

    14. Expenditure incurred in the home country
      LHV shall not compensate expenses incurred in the home country, even if these were caused by an insured event that occurred abroad.

    15. Costs related to illness or injury that appeared or was sustained before the start of the trip
      LHV shall not reimburse treatment costs caused by an illness or an injury that appeared before the trip. This exemption is not applied to first aid in the case of life-threatening exacerbations of chronic illnesses. A chronic disease is one that is recurrent or continuous in nature.

    16. Costs of scheduled treatments
      LHV shall not cover the cost of planned medical treatment, including planned cosmetic surgery, planned dental treatment or treatment and/or follow-up treatment in the home country.

    17. Pregnancy and childbirth
      LHV shall not cover the cost of pregnancy, childbirth, abortion or related complications, as well as post-natal care or treatment, if the pregnancy has lasted more than 35 weeks. The exclusion is applied to the costs related to both the mother and the baby.

    18. Costs incurred by the family member travelling to the insured person or by the travelling companion remaining with the insured person

      • LHV shall not reimburse the accommodation costs for the time when the insured person had recovered to such an extent that it would have been medically possible for them to return to or be returned to their home country at the first opportunity.
      • LHV shall not reimburse the costs incurred by the family member travelling to the insured person or by the travelling companion remaining with the insured person for the time when the insured person had recovered to such an extent that it would have been medically possible for them to return to or be returned to their home country.
    19. Costs of obtaining medical documents
      LHV shall not reimburse travel and accommodation expenses related to obtaining medical documents.

    20. Travel expenses of other persons

      • LHV shall not compensate the travel and accommodation expenses of a travel companion and or family member accompanying the insured person within the extent to which the latter should have incurred costs even if no insured event had occurred.
        Example. The accompanying person’s expenses are not reimbursed if the insured person is hospitalised during the trip, but the travel plan of the accompanying travelling companion does not change, i.e. he/she stays in the same place and returns to the home country at the planned time.
      • LHV shall not compensate the travel expenses (transport, accommodation, etc.) of persons attending the funeral or cremation ceremony of the insured person or the expenses of a funeral banquet.
    21. Costs of returning the insured person to his/her home country

      • LHV shall not reimburse the cost of returning to the home country when the insured person returned from the trip themselves without co-ordinating it with LHV beforehand, or disregarded the instructions of LHV or their doctor upon returning to their home country.
      • If a doctor, approved by LHV, considers it possible to return the ill or injured insured person to their home country, but the patient or the injured insured person rejects this, LHV shall not reimburse any further costs.
      • If a doctor, approved by LHV, does not consider the return of the ill or injured insured person to their home country to be medically justified, LHV shall not reimburse the costs of returning the ill or injured insured person to the home country.
    22. High-risk activities
      LHV shall not reimburse the cost of medical assistance if the loss or damage has been caused in the course of any of the following high-risk activities:

      • any competitive sport, including preparation for competitions and participation in training camps;
      • snowboarding, alpine skiing, and slalom outside the marked trails of winter sports centres;
      • diving deeper than 20 metres, sailing offshore, water motorsports (jet skiing, towing any equipment with a vessel), rafting, water skiing, and windsurfing, surfing, and kitesurfing;
      • car or motor sports, incl. driving ATVs and participating in training for driving with motor vehicles, vehicle testing, rally, kart racing, driving snowmobiles, and participation in motorbike sports;
      • air sports, including hang gliding, paragliding, gliding, and ballooning;
      • sports that require special equipment, including alpinism and ice, rock, wall and mountain climbing;
      • expeditions and trips to heights exceeding 4,500 metres above sea level;
      • independently organised trips, expeditions to rain forests, deserts, tundra, Arctic regions, virgin forests, etc.;
      • extreme sports, incl. down-hill cycling, bicycle tricks, BMX riding, skateboard tricks, free-riding, heli-skiing, etc.;
      • parachute and bungee jumps;
      • tobogganing, ski jumping, and speed skiing;
      • martial arts or sports related to self-defence, such as karate, judo, boxing, kickboxing and Thai boxing, and wrestling;
      • all other comparable sports and extreme sports that comprise a higher than usual risk of getting lost, ill, dying or receiving bodily injuries.
    23. Paid physical labour
      LHV shall not reimburse the cost of medical care if the injury is sustained while working in the following employment or occupation:

      • professional athlete or stuntman/woman;
      • a miner or a worker on a drilling rig;
      • fisherman, ship worker or diver;
      • member of a plane crew;
      • policeman, security guard, rescuer or mine clearing expert;
      • conscript in military service or border guard service;
      • participant in any military activities, drills or exercises and military missions, including an observer or person engaged in other works;
      • any work, job or activity, during the performance of which the insured person carries or uses a weapon or handles explosives.
    24. Other exclusions
      LHV shall not compensate the following costs:

      • that are avoidable;
      • procedures and services not prescribed by a doctor;
      • rehabilitation;
      • non-medical treatments or alternative medicine;
      • medical treatment provided by an unlicensed person;
      • getting or removing a tattoo and complications thereof;
      • the diagnosis and treatment of psychiatric and behavioural disorders, including depression;
      • the diagnosis and treatment of sexually transmitted diseases, HIV-virus and AIDS;
      • vaccination, except for vaccination for the treatment of an insured event of medical insurance.
  5. Baggage insurance

  6. Insured baggage is the personal belongings of the insured person when travelling.

    1. An insured event of baggage cover is represented by the following events that occur during the period of validity of the insurance with the insured baggage in the insured area.

      • Damage, destruction, theft, or robbery of baggage as a result of an unexpected and unforeseen event
        In the case of damage, destruction, theft, or robbery of baggage, the sum insured is € 1,000.
      • Loss of baggage due to the fault of the transport company
        In the case of loss of baggage, the sum insured is € 1,000. baggage is considered lost if it does not reach the insured person or if the transport company fails to provide information on its location and the time of its delivery to the insured person within 21 days of the originally scheduled arrival time.
      • baggage delay of more than four (4) hours due to the fault of the transport company
        If the baggage is delayed for more than four (4) hours due to a transport company abroad, LHV shall reimburse the costs for the purchase or rental of basic goods and essential items that would have been in the delayed baggage in an extent of up to € 500.
      • Identity document, visa, or vaccination certificate lost or destroyed with baggage
        LHV shall reimburse up to € 200 of the costs incurred for obtaining a replacement for an identity document, visa or vaccination certificate that was lost or destroyed due to an insured event of baggage cover.
    2. The following are not insured as baggage:

      • tickets, money, securities, bankcards;
      • delicate items, e.g. glass, clay or porcelain items;
      • glasses, sunglasses, contact lenses;
      • tools and work equipment;
      • a sailboard and its sail;
      • items leased, rented, or borrowed during the trip;
      • food, beverages and tobacco products;
      • goods and samples offered for sale;
      • manuscripts, drawings, photos, advertising and training material, and other such documents;
      • software and databases;
      • motor vehicles, trailers, watercraft, aircraft, their spare parts, accessories;
      • plants, including seeds, bulbs, rhizomes;
      • animals, birds, insects, amphibians, reptiles;
      • items, the possession of or import of which into the home country is illegal.

      General principles for the compensation of damage to baggage

    3. In the case of damage to the property, LHV shall reimburse the repair costs. If the property is destroyed or damaged in such a way that it cannot be repaired, or the baggage has been stolen, robbed or lost due to the fault of a transport company, LHV shall reimburse the costs of repurchasing an equivalent item.

    4. If it is not possible to determine the repurchasing cost of the item, the indemnity shall be determined based on the purchase price of the item. Depreciation in value of the item over time at a rate of 10%–30% of the purchase price per year shall be deducted from the purchase price.

    5. For baggage damage, a deductible of € 50 per insured event applies, except for computer, photographic and electronic equipment and accessories, for which the deductible is € 200.

    6. If LHV has reimbursed the baggage and the baggage is found, the insured person must notify LHV thereof as soon as possible.

    7. LHV shall not arrange for the repair of the item, the acquisition of a replacement item, or the transfer of the item to the insured person.

      What to do in the event of damage to baggage

    8. In the case of damage to baggage, the insured person must first contact the transport company, hotel, etc., responsible for the damage and file a claim for damages.

    9. In the event of a baggage delay, a certificate must be presented for the delayed baggage along with invoices for purchasing or renting indispensable items.

    10. If the baggage damage was caused due to the fault of the transport company or accommodation establishment or another provider of a storage service, LHV must be presented a certificate of this enterprise regarding the reasons for baggage loss.

    11. Theft or robbery of baggage must be immediately reported to the police. A police certificate regarding the circumstances of the event must be presented to LHV.

    12. LHV has the right to demand the submission of additional evidence, such as invoices for the repair of items, photographs, additional explanations, etc.

      Safety requirements for the storage of baggage

    13. Baggage must be stored under supervision or in a locked room.

    14. Items left in a vehicle must be placed in such a way that they do not attract attention. When leaving the vehicle, all windows and the sunroof must be closed, doors locked, and security devices activated.

    15. When unsupervised, a bicycle must be locked to a strong base.

    16. The following is a list of items that must be carried in hand baggage and may not be placed in the hold of an aircraft, ship, bus or train, or left unattended in a vehicle, but must be under the uninterrupted and immediate supervision of the insured person or in a safe or supervised storage room in the accommodation establishment:

      • personal identity document, visa vaccination certificate;
      • electronic equipment, including camera, phone, smart device, laptop and tablet;
      • firearms (firearms may be transported in accordance with the carrier's regulations);
      • musical instruments (musical instruments may be transported outside of hand baggage pursuant to the rules of the carrier);
      • valuables, watches, works of art and antique items;
      • collections.
    17. The insured person must comply with all legislation, instructions, guidelines, precepts, etc., of the transport company, which contain guidelines for ensuring safety, preventing and minimising possible damage.

      Exclusions from baggage cover

    18. LHV shall not compensate damages incurred:

      • due to failure to comply with the safety requirements set out in clauses 3.13 to 3.17;
      • due to the theft of objects left in an open or canvas covered trailer of a vehicle, unlocked roof box, motorcycle baggage box or bag;
      • when items came into contact with liquids contained in the baggage;
      • because of the baggage being left unattended, lost or forgotten.
        Example. LHV shall not compensate damage caused by the theft of baggage after it has been left behind;
      • baggage that reached the home country after a delay;
      • in the case of breakage of an item made of glass, porcelain, ceramics or similar fragile materials, including the subsequent damage caused to other items.
  7. Accident insurance

  8. An insured event of accident insurance is an accident which occurred with the insured person when travelling abroad within the area covered by the insurance, as a result of which:

    • the insured person dies within three (3) years of the occurrence of the accident;
    • the insured person develops a permanent disability within three (3) years of the occurrence of the accident.
    1. The sum insured for accident insurance is:

      • in the case of permanent disability up to € 50,000;
      • In the case of death (person over 16 years of age) up to € 50,000;
      • in the case of death (person less 16 years of age) € 2,000.
    2. Death benefit
      The amount of the death benefit is the sum insured of accident insurance. Death benefit is paid to the insured person’s beneficiaries. If the insured person dies later than within three (3) years after the occurrence of the insured event of accident insurance, no death benefit will be paid. The death benefit is reduced by the permanent disability indemnity previously paid for the same insured event.

    3. Permanent disability indemnity
      LHV pays a permanent disability indemnity to the insured person if his or her health condition has permanently deteriorated due to the insured event. The existence and degree of permanent disability is established on the basis of medical documentation. The permanent disability indemnity is paid as a percentage of the sum insured for the accident, based on the condition of the insured person one (1) year after the occurrence of the insured event.

      • The permanent disability benefit is 25% of the insured sum of the insured event, if one (1) year after the insured event the insured person generally does not require outside help, but his/her general ability has decreased: he/she has memory impairment, speech and communication difficulties, loss of movement accuracy, imbalance, rapid fatigue and other conditions aggravating or obstructing everyday activities.
      • The permanent disability indemnity is 50% of the insured sum of the insurance event if, one (1) year after the insured event, the insured person is only able to perform light and short-term activities, his/her ability is significantly reduced and he/she is dependent on the assistance of another person for some daily activities (such as eating, washing, dressing, movement inside or outside the home, etc.).
      • The permanent disability indemnity is 100% of the insured sum of the insurance event if, one (1) year after the occurrence of the insured event, the insured person absolutely needs the assistance of another person in performing all daily activities (such as eating, dressing, moving around, washing, etc.).
    4. The existence and degree of permanent disability caused by the insured event within the meaning of the conditions shall be determined no later than within one (1) year as of the occurrence of the insured event, based on the health condition of the insured person at that time.

    5. A permanent disability is determined by comparing the insured person’s state of health with that of a healthy person of the same age, taking into account only the severity and nature of the disability and not the insured person’s individual characteristics, such as lifestyle, occupation or hobbies. Loss of capacity for work and loss of income are not accounted for when establishing permanent disability. The degree of severity of the permanent disability established by expert medical assessment is not binding for LHV in establishing the permanent disability.

      What to do in the event of an insured event accident

    6. In the event of an insured event accident, the Medical Assistance Code of Conduct set out in clauses 2.10–2.13 of the Terms and Conditions shall apply.

      Exclusions from accident insurance

    7. LHV shall not compensate damage if the death or permanent disability was caused or aggravated by:

      • the insured person’s illness (the insured event is not death or development of a permanent disability due to illness);
      • any medical procedure, including surgery (the exemption shall not apply if the cause of the medical procedure is the accident that occurred abroad during the validity of the conditions);
      • bite or sting by a tick or bug;
      • miscarriage or childbirth, complications due to miscarriage or childbirth;
      • an accident which occurred while the insured person was in a detention centre as an inmate, prisoner or detainee;
      • high-risk activities excluded by medical assistance insurance.
    8. LHV shall not pay permanent disability indemnity:

      • in the case of damage to the insured person’s teeth or prosthetics;
      • if the permanent disability appears later than within one (1) year after the insured event;
      • if the insured person dies as a result of the insured event within one (1) year from the date of the insured event. In that case, LHV shall pay the death benefit.
  9. Liability cover

  10. Liability insurance covers damage to property or personal injury, which the insured person has unlawfully caused to a third party abroad during the term of the insurance and which the insured person must compensate because he or she is guilty of causing the damage or is responsible for causing it under legislation. LHV shall pay the indemnity in the event of a loss for which a written claim for indemnification has been submitted to the insured person. The sum insured for liability insurance is € 100,000 per insured event.

    1. Third party claims that have occurred abroad and are related to damage to sports equipment, premises, apartments, or buildings belonging to the injured party in the possession or use of the insured person are insured up to € 2,000.

    2. LHV reimburses any direct proprietary damages caused to the third party as a result of the insured event and legal costs of the insured person arising from the insured event, that are directly necessary for resolving the proprietary damage claim presented to the insured person.

      Activities in the case of an insured event covered by liability insurance

    3. If an insured person is presented with a claim for compensation or if circumstances arise that may be the basis for a claim, such as the causing of damages, he or she must immediately contact LHV and act in accordance with LHV’s instructions.

    4. Legal assistance expenses must be agreed upon with LHV in advance.

    5. If LHV is of the opinion that it is expedient to settle the dispute by means of an agreement, the insured person must respond to LHV’s proposal within five (5) days, unless LHV has set a longer deadline.

      Third party liability insurance exemptions

    6. Intentional activity and/or intoxication
      LHV shall not compensate claims arising from acts committed by the insured person intentionally and/or while intoxicated or under the influence of psychotropic substances.

    7. Compulsory liability insurance (such as motor third party liability insurance)
      LHV shall not pay compensation for damage covered by compulsory liability insurance.

    8. Items in the possession or use of the insured person
      LHV shall not reimburse damages for the destruction, damaging or loss of an item in the possession or use of the insured person, such as a rental car (excluding cases mentioned in clause Error! Reference source not found.).

    9. Loss of profit
      LHV shall not reimburse lost profit, including lost salaries, except for the decrease or loss of income of the injured party in the case of causing damage to the health or death of the injured party.

    10. Persons to whom damages are not reimbursed
      LHV shall not compensate damage suffered by the insured person himself/herself, his/her travelling companion or a member of his/her family, or by a company of which the insured person is a member of the board, a shareholder or a member of the supervisory board.

    11. Sanctions
      LHV shall not reimburse any fines or other punishments imposed on the insured person.

    12. Infectious diseases and sexually transmitted diseases
      LHV shall not compensate damage caused by the spreading of an infectious disease and/or sexually transmitted disease.

    13. Epizootic pathogens and pests
      LHV shall not compensate damage caused by epizootic pathogens or hazardous pests.

    14. Sports equipment
      LHV shall not consider any motor vehicle, watercraft or aircraft to be sports equipment.

    15. Activities not covered by insurance
      LHV shall not compensate damage related to the insured person’s:

      • economic or professional activities;
      • fulfilling professional or service assignments; acting as a member of the governing body of a legal person;
      • providing a service for a fee;
      • sports competitions or professional sports;
      • the possession or use of any vehicle;
      • ownership or possession of the building;
      • use of a gun.
    16. Activities in the case of an insured event covered by liability insurance
      LHV shall not compensate damage if the insured person fails to respond to LHV’s proposal by the deadline or fails to conclude an agreement. LHV also shall not reimburse any costs of expert assessments, legal assistance and court expenses, which may be incurred after the term of replying to LHV’s proposal or entering an agreement has passed.

  11. Legal costs

  12. The indemnity limit for an insured event involving legal expenses insurance is € 10,000. An insured event is an unlawful act committed unintentionally by the insured person outside the home country during the trip, due to which:

    • the competent authority started criminal or misdemeanour proceedings or issued a decision to release the insured person for a security in accordance with law; or
    • a third party submitted a private law claim against the insured person pursuant to law.
    1. In the event of an insured event covered by legal expenses insurance, LHV shall compensate up to € 5,000 in accordance with the decision of a court or other competent authority and reasonable and/or necessary legal expenses, considering the circumstances of the case, the complexity of the legal dispute, the amount of the claim and the usual price of such services in the country.

    2. In the event of a bail refund, the insured person is obliged to repay it to LHV within 10 (ten) days of the bail refund. The insured person shall immediately notify LHV of the return of the security.

    3. When the need for legal assistance arises, it must be reported to LHV immediately, proceeding according to LHV’s instructions.

      Calls made to LHV from a foreign country

    4. LHV reimburses any phone calls made to LHV and LHV’s claims administration partners, transport companies, travel agencies, accommodation providers and other travel service providers in relation to the insured event.

    5. The insured sum of phone calls is € 200 for all calls made during a single trip.

  13. Rental car insurance

  14. An insured event is the theft, robbery, destruction or damaging of a vehicle described in clauses 8.1. to 8.3. that has been hired by the insured person from a company providing short-term vehicle hire services abroad, as a result of which the insured person must compensate the lessor for the damage caused to the hired vehicle.

  15. Rental car insurance applies to the following types of rental cars:

    1. a vehicle of category M1 or similar (passenger car with up to eight (8) seats in addition to the driver’s seat and a maximum mass not exceeding 3.5 tonnes);
    2. a vehicle of category N1 or similar (van with a maximum mass not exceeding 3,5 t);
    3. a vehicle of category O1 and O2 or similar (trailer with a maximum mass not exceeding 3,5 t).
    4. The rental car insurance also covers rental car equipment fitted to the rental car in such a way that it cannot be removed from the vehicle without the use of tools without damaging it.
    5. Insurance does not cover:
      1. a camera, navigation device and other accessories that can be removed from the rental car without the use of tools;
      2. a vehicle rented from the home country, incl. if the vehicle is used for travel abroad;
      3. a vehicle which is not rented from a company providing a short-term hire service.
        Example. Rental car insurance does not cover a vehicle borrowed from a friend, neighbour, employer or business partner.
    6. The sum insured for rental car insurance is the amount of the reasonable loss to be claimed by the lessor from the insured person for damage to, destruction of or theft of the rental car, up to a maximum of € 20,000.
    7. In the case of rental car insurance, a deductible of € 100 per insured event applies. The insurance deductible is deducted from the insurance benefit payable. If the insured object has been damaged or destroyed as a result of several insured events, the deductible shall be applied separately for each insured event.
  16. The deductible for rental car insurance does not apply if the rental car is covered by a comprehensive insurance policy which meets the following minimum requirements:

    1. comprehensive insurance includes a minimum of accidental damage cover, which is usually stated in the rental contract in English as Collision Damage Waiver (CDW), Loss Damage Waiver (LDW) or Physical Damage Waiver (PDW);

    2. the insured person’s deductible under the rental contract shall not exceed € 2,000.

      Acting upon receipt and transfer of a rental car and in the case of an insured event with a rental car

    3. In order to detect any damage, the insured person must inspect the rental car upon its delivery and receipt and document any visible defects and damage with the grantor or lessor of the car. The insured event must also be documented together with the lessor of the vehicle.

    4. in order to receive the indemnity, the insured person must present LHV the loan or rental agreement for the vehicle along with the insurance contract and claim for damage.

      Safety requirements

    5. When leaving their rental car, the driver must close all its windows and the roof hatch, lock all doors, remove all keys, remote control devices and documents, and activate anti-theft equipment.

    6. Keys, remote controls, and documents must be stored in a place and in such a way that they cannot be easily removed by a third person. This requirement shall not apply if the rental car was stolen from the repair shop to which LHV directed it for repair.

    7. After damage to the rental car, it can be used if it has been inspected and verified that it is in the technical condition required for use, for instance, no oil or fuel leaks, the tyres are intact and the steering wheel and brakes are working.

    8. Only a person who has a respective valid driving licence and driving authorisation in the country where the car is used is allowed to drive a rental car.

    9. The rental car must be in the technical condition required by law, such as having tyres appropriate for the season and the permissible degree of wear and tear, and with brakes and lights in order.

    10. The rental car may only be used for the purpose and to the extent permitted by the manufacturer.

      Rental car insurance exemptions

    11. Other damages reimbursable under the contract
      LHV shall not compensate damage that is reimbursable on the basis of the mandatory motor third party liability insurance or other insurance contract.

    12. Use of the rental vehicle by a person who has not been named as a driver in the rental agreement
      LHV shall not compensate damage when the rental vehicle was used in violation of the Terms and Conditions of the rental agreement, including when it was driven by the person not permitted to do so under the rental agreement.

    13. Participation in competitions and races with a rental car
      LHV shall not compensate damage caused by the use of a rental car in a competition or a race or in the practice thereof, regardless of whether it was lawfully arranged.

    14. Related persons
      LHV shall not compensate damage if the following person committed an intentional act of damaging the rental car, theft, robbery or attempted those acts:

      • the insured person and/or his/her travel companion;
      • the legal possessor of the rental car, his or her representative, employee, or person under his or her guardianship;
      • the parent, child, grandchild, spouse, life partner, daughter-in-law, or son-in-law of the insured person or the legal possessor of the rental car;
      • person who lives with the insured person or the legal possessor of the rental car in a common household.
    15. State of intoxication of the driver
      In determining the state of intoxication, LHV proceeds from the limits permitted by the laws of the country where the insured event occurred.

      • LHV shall not compensate damage if the driver of the rental car was intoxicated at the time of the accident.
      • LHV shall not compensate damage if the driver of the rental car consumed an intoxicating substance after the traffic accident, but before the state of intoxication was verified by the police or a medical facility, or declined establishing the state of intoxication.
    16. Leaving the scene of the incident
      LHV shall not compensate damage if the driver of the rental car leaves the scene after the incident, being in violation of the law.

    17. Use of a rental car off-road

      • LHV shall not compensate damage which occurred in a territory closed to traffic (for example, an airfield, a mine, a road construction area, etc.).
      • LHV shall not compensate damage caused on a body of water outside an officially open ice road.
      • LHV shall not compensate damage that occurred in an area not intended for traffic, if the damage is related to the characteristics of the area.
        Example. Damage caused by driving a rental car in a bog due to sinking into a quagmire or hitting a stump while off-road driving is not covered.
    18. Driving a rental car in deep water
      LHV shall not compensate damage caused by water entering the rental car, its engine, or equipment because it was driven in deep water, e.g. in the event of a road flood.

    19. Competition or race
      LHV shall not compensate damage caused by the use of a rental car in a competition or a race or in the practice thereof, regardless of whether it was lawfully arranged.

    20. Maintenance, wear, and warranty

      • LHV shall not compensate damage caused by the insured person or the user of the rental car due to repairing or maintaining the vehicle himself/herself, incl. charging the battery, changing the vehicle’s spare parts, installing tyres, etc.
      • LHV shall not compensate damage for which the lessor, manufacturer, seller or repairer is liable, e.g. for damages indemnified under a manufacturer’s warranty.
      • LHV shall not reimburse the cost of eliminating a rental car failure unless the failure was caused by a sudden and unforeseen circumstance independent of the rental car.
      • LHV shall not compensate damage caused by incomplete, incompetent, or improper maintenance or repair, unless the repair or maintenance service provider was accepted by the lessor and had the required qualification and/or registration in the respective country.
      • LHV shall not compensate the cost of maintenance or replacement of worn parts.
      • LHV shall not consider the exemptions set out in the first four subclauses of clause 9.20. in the event of fire, driving off the road, overturning or collision, provided that the rental car has been properly maintained and inspected.
    21. Oil, other liquid, or gas in rental car equipment
      LHV shall not compensate damage caused by the incorrect amount, circulation or use of oil, other liquid, or gas in rental car equipment, unless it was due to an insured event.

    22. Illegal or incorrect fuel
      LHV shall not compensate damage to the rental car engine caused by the illegal or incorrect use of fuel.

    23. Normal wear and tear, depreciation, and rusting
      LHV shall not compensate damage caused by normal wear and tear, depreciation, or rusting of the rental car.

    24. Rescue Board expenses or other similar expenses
      LHV shall not compensate the costs related to the Rescue Board or other public institution.

  17. General exclusions

  18. General exemptions are applied to all insured events.

    • LHV shall not compensate damage in the absence of an insured event.
    • LHV shall not compensate damage if the event that caused the damage was foreseeable.
    • LHV shall not compensate damage or costs that are not in compliance with the characteristics of compensated damages or costs.
    • LHV shall not compensate any costs that the insured person would have made regardless of the insured event.
    1. Foreseeable event
      LHV shall not compensate damage when damages were caused by circumstances that were known or foreseeable to the insured person before the beginning of the trip.
    2. Moral damage
      LHV shall not compensate moral, i.e. non-material damages.
    3. Incident in the home country
      LHV shall not compensate damage if the event that caused it took place in the home country. This exclusion is not applied to travel interruption insurance in the cases specified in the Terms and Conditions.
    4. Activities of the insured person
      LHV shall not compensate damage, if:
      • the insured person caused the insured event either intentionally or due to gross negligence;
      • the insured person caused the insured event when driving a vehicle they were not legally allowed to drive;
      • the damages were caused or partially caused by an act committed by the insured person that has traits of an intentionally committed criminal offence;
      • the Policyholder or the insured person presented inaccurate information to LHV.
    5. Intoxication
      LHV shall not compensate damage if the insured event or damages were caused or partially caused by the insured person being intoxicated (including alcohol or narcotic substances) or the residual effects thereof.
    6. Searching for the insured person
      LHV shall not cover the costs of searching for the insured person.
    7. Damage compensable to another person
      • LHV shall not compensate damage that is paid under national or foreign motor third party liability insurance.
      • LHV shall not compensate damage if the health insurance fund, insurance provider, transport company, travel service provider or another person has already compensated the costs or made a decision on compensating them.
    8. Bankruptcy and insolvency
      LHV shall not compensate damage when damages were caused by the bankruptcy or insolvency of a service provider involved in the trip.
    9. Pandemic, epidemic, and infection control measures
      LHV shall not compensate damage if it was caused by a pandemic, epidemic, or an infection control measure implemented by the state, except for the travel interruption compensation when the trip was interrupted due to an evacuation. The exemption does not apply to medical care insurance if the insured event occurred within 14 days after the outbreak of the pandemic or epidemic, or the implementation of infection control measures and the insured person was already travelling before the aforementioned event. This exclusion does not apply to cases described in clause 3 ('Covid-19 cover').
    10. War, armed conflict, insurgence, mass unrest
      LHV shall not compensate damage if it was caused by war or armed conflict, insurgence, revolution or mass unrest, except for travel disruption compensation due to an evacuation interrupting the trip. If the insured person does not participate in said activities and arrived to the respective area before the start of the dangerous situation, their medical insurance is still valid for 14 days from the start of the dangerous situation. In the case of war between the permanent members of the United Nations Security Council, the war exemption is applied immediately at the start of the war and the 14-day insurance cover does not apply.
    11. Terrorism
      LHV shall not compensate damage caused by terrorism, except for the evacuation of an interrupted trip and unavoidable medical expenses due to the direct consequences of an act of terrorism.
    12. Other exclusions
      LHV shall not compensate damage if it was caused by:
      • a nuclear weapon, nuclear power, or radioactivity;
      • the activities of the police, border guards, customs officers, or other public officials;
      • seizure, detention, confiscation, or expropriation of property.
  19. Behaviour in the event of a loss event

  20. The insured person must, in the event of a loss event:

    1. take measures to prevent or reduce further damage;
    2. report a crime (including theft, robbery, vandalism or any other unlawful act by a third party) immediately to the local police, a fire to the local emergency services, and the appropriate competent authority or person in any other case;
    3. report the theft or robbery immediately to the local police. The police must be notified of any damage caused. At the request of LHV, a written notice issued by the police or another notified body which certifies the registration of the event and the fixation of the damage caused must be submitted;
    4. notify LHV of the loss event as soon as possible after the occurrence of the loss event or becoming aware of it;
    5. in the event of a claim, provide LHV with accurate and complete information about the circumstances of the claim, the amount of the claim and the persons who may be liable;
    6. follow the code of conduct provided by LHV;
    7. if necessary, provide LHV with access to the damaged item;
    8. enable LHV to investigate the circumstances of the damage event in order to identify the amount of the loss and the persons responsible for the loss and, if necessary, to involve experts to determine the circumstances of the damage event.
    9. consider that to establish the circumstances of the loss event, LHV may demand from the insured person, inter alia:
      1. Providing LHV with documents (including original documents) proving the loss or damage or the costs incurred as a result of it;
      2. submission of a certificate issued by the police in the case of an offence against persons or property;
      3. providing explanations about the claim.
  21. General principles for indemnification

  22. In the event of an insured event, LHV shall compensate direct and justified expenses for the restoration or replacement of the insured items and other expenses provided in the terms and conditions. LHV’s general principles for indemnification are the following..

    1. LHV shall make a decision on the compensation of direct damage within 10 (ten) working days of receiving all the necessary information on the loss event and the amount of damage. If, for reasons beyond LHV’s control, it is not possible for LHV to determine the full amount of the damage, LHV shall first indemnify the part of the damage, the extent of which is clear. LHV may extend the deadline for making a decision on indemnification of damage for good reason.
    2. LHV has the right to request documents and information related to the loss event from third persons.
    3. The right to receive the insurance benefit is held by the insured person or a company providing a service to them, such as travel agencies, medical facilities, etc.
    4. LHV determines the method for the compensation of damage, which may be the repair of a damaged object, replacement of the object with an equivalent object, or financial compensation, and LHV may also choose a repair company or a place from which an equivalent object is procured upon replacement. The corresponding solution can be arranged and ordered by LHV.
    5. LHV has no obligation to compensate the value of the remaining part of the insured object. If LHV reimburses the costs of replacing the insured object, LHV has the right to the ownership of the replaced object.
    6. If the insured person wishes to keep the destroyed object in his or her own possession, the insurance benefit shall be reduced by the value of the property after the insured event.
    7. Other costs specified in the Terms and Conditions shall be reimbursed by LHV on the basis of a document certifying the amount of such costs to a reasonable and justified extent.
  23. Obligations of the insured person

  24. The insured person is obliged to:

    1. do everything in their power to prevent the insured event and reduce possible damage, to avoid the possible increase of the insured risk and not to allow the persons who use the insured property to increase the insurance risk;
    2. after LHV has paid the insurance benefit for the stolen or robbed item, return the insurance benefit to LHV after the return of the item, or transfer the returned item to LHV ;
    3. return the insurance benefit paid to him or her to LHV if, after indemnification of the damage, circumstances precluding indemnification by LHV become apparent or if the damage is compensated by a third party.
  25. Obligations of LHV

  26. LHV shall be required to:

    1. start handling the insured event immediately after receiving the notice of loss, and determine the amount of indemnifiable loss;
    2. after receiving the notice of loss, inform the insured person of which documents he/she must submit to LHV in order to determine the cause and amount of the loss;
    3. compensate the damage caused due to the insured event or pay the agreed amount of money or the insurance benefit in one (1) or more parts, and fulfil the conditions in another agreed manner. LHV shall pay the insurance benefit within a reasonable time after the completion of the claims handling operations and the indemnification decision. If LHV delays the performance of a financial obligation, it is required to pay default interest at the rate provided in the Law of Obligations Act;
    4. compensate the necessary expenses incurred by the insured person in connection with the determination of the damage and the determination of the amount thereof, inter alia, upon the occurrence of the obligation to indemnify the damage. LHV shall not have to compensate the insured person for the costs of hiring an expert or adviser if the insured person was not obliged to hire an expert or adviser according to the conditions.
  27. Refusal to compensate or reduction of compensation

  28. LHV has the right to refuse to indemnify or reduce the insurance benefit, if:

    1. the insured person has intentionally submitted false or misleading information to LHV or failed to submit important information concerning the material circumstances of the loss event;
    2. it is an event, as a result of which the damage caused is not compensated on the basis of the conditions;
    3. the damage has occurred to objects that are not insured under the conditions;
    4. the insured person has not complied with a safety requirement or obligation set out in the conditions and there is a causal link with the occurrence of the damage.
  29. LHV has the right to refuse to pay the insurance benefit if the payee is subject to a respective international financial sanction imposed by the Government of the Republic, the United Nations, the European Union, the United Kingdom or the United States of America.

  30. Expiration of the insurance cover

  31. The insurance cover expires upon expiry of the card (except when the card is closed or blocked due to its loss, theft, or robbery) or upon the expiry of the insurance contract concluded between LHV and the Policyholder.

  32. Upon expiry of the card, the insurance cover continues if the insured person orders a new card from LHV that provides insurance cover under the same conditions. If the card expires during a trip, the insurance cover is valid until the end of the 90th day of the trip.

  33. The policyholder notifies the insured person of the termination of the insurance contract entered into with LHV 60 days before the termination of the insurance contract.

  34. Multiple insurance

  35. If the insured person insures the same insurance risk with several insurers and the total amount of insurance benefits paid by the insurers exceeds the amount of the loss or the sum insured exceeds the insurable value, the insurers are jointly and severally liable (multiple insurance).

  36. Communication of notices

  37. All notices necessary to comply with the conditions shall be provided in a form that can be reproduced in writing.

  38. Processing of personal data

  39. LHV has the right to process personal data related to the conditions on the basis of LHV’s customer data processing principles and to disclose information related to the conditions to a third party whose right to receive information arises from LHV’s customer data processing principles.

  40. LHV has the right to preserve the recordings received by means of communication or other means in connection with the fulfilment of the conditions and, if necessary, use them to prove the declarations of intent submitted by the insured person.

  41. Law applicable to the Terms and Conditions and limitation of claims arising from the Terms and Conditions

  42. The law of the Republic of Estonia applies to the Terms and Conditions.

  43. The limitation period for claims arising from the conditions is three (3) years. The limitation period shall run from the end of the calendar year in which the claim becomes due.

  44. Inconsistencies in the documents of Terms and Conditions

  45. If the terms and conditions have been translated into a foreign language, the interpretation of the terms and conditions will always be guided by the Estonian language terms and conditions in case of dispute.

  46. Supervision and settlement of complaints

  47. If the policyholder does not agree with the decision by LHV or requests additional explanations, they have the opportunity to contact LHV by email at kindlustus@lhv.ee, by phone at 699 9111 and by post at Tartu mnt 2, 10145, Tallinn.

  48. The extrajudicial bodies for resolving disputes are the conciliation body of the Association of Estonian Insurance Companies, Mustamäe tee 46, 10621 Tallinn (phone 667 1800, email lepitus@eksl.ee), and the Consumer Protection and Technical Surveillance Authority, Endla 10a, 10122 Tallinn (phone 667 2000, email info@ttja.ee).

  49. LHV’s activities as an insurer are supervised by the Financial Supervision Authority (Finantsinspektsioon), Sakala 4, 15030 Tallinn (phone 668 0500, e-mail info@fi.ee, website www.fi.ee), which does not settle contractual disputes between LHV and the insured person.

  50. If no agreement is reached, the parties have the right to apply to the county court.
